The agreement you make with us when you use everylake.co or buy a map. Buying anything, or using the site at all, means you accept these terms.
Who we are
Every Lake is operated by Tempist LLC, d/b/a Every Lake (“Every Lake”, “we”, “us”), PO Box 7, 101 High St, Waterford, PA 16441. These Terms of Service (“Terms”) govern your use of everylake.co and any purchase you make from us. By using the site or placing an order you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.
The products
Our maps are decorative objects made from laser-cut wood using publicly available depth and elevation data, road data and place names. They are works of art, not navigational charts. Depths, contours, shorelines and distances are simplified, generalized and in many cases estimated from models rather than surveyed. Never use an Every Lake product, image, 3D preview or web page for navigation, safety, engineering, real-estate, legal or any other decision where accuracy matters.
Every piece is made to order from natural wood. Grain, color, small burn marks at cut edges and minor variations between the preview image and the finished piece are normal and are not defects. Sizes are nominal; the finished board may differ from the stated dimension by up to one inch.
Orders, prices and payment
Prices are in U.S. dollars and may change at any time; the price shown at checkout is the price you pay. We may correct errors in pricing or descriptions, including after an order is placed, in which case you may cancel for a full refund. Payment is processed by Stripe, Inc.; we never see or store your full card number. Sales tax is charged where we are required to collect it.
An order is accepted when we send an order confirmation. We may refuse or cancel any order — for example if the data for a lake turns out to be unusable, the piece cannot be made in the size requested, or we suspect fraud — and will refund anything you paid for it.
Commissioned lakes (lakes not already in our catalog) are built from the best data we can find. We will send you a preview before cutting; you may cancel for a full refund at any point before you approve the preview. After approval the order is treated like any other made-to-order piece.
Shipping, damage and returns
Our Shipping & Returns policy is part of these Terms. In short: made-to-order pieces cannot be returned because you changed your mind, but if a piece arrives damaged or with a defect in materials or workmanship we will repair, replace or refund it — tell us within 14 days of delivery with photos.
Your content
If you ask for personalization — a name, a date, a marker on a location — you confirm you have the right to use that text and it is not unlawful, defamatory or infringing. You give us a non-exclusive license to use it to make your piece and, unless you tell us otherwise in writing, to show photographs of the finished piece in our marketing.
Intellectual property
The site, its text, images, 3D previews, the design of our maps, our cut files, our name and our logo belong to Tempist LLC or our licensors and are protected by copyright and trademark law. You may not copy, scrape, reproduce, sell or create derivative works from any of it without our written permission. Map data is derived from public sources including NOAA, USGS, GLOBathy (CC0) and OpenStreetMap (© OpenStreetMap contributors, ODbL); nothing here restricts your rights in those underlying sources.
Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SITE AND OUR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY MAP, DEPTH, CONTOUR OR PLACE NAME IS ACCURATE OR COMPLETE. Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TEMPIST LLC AND ITS MEMBERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, OUR PRODUCTS OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, A PRODUCT OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100) IF YOU DID NOT BUY ANYTHING. Some states do not allow these limitations, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify and hold harmless Tempist LLC and its members, employees and contractors from any claim, loss, liability, damage or expense (including reasonable attorneys' fees) arising out of your use of the site or a product, your personalization content, or your breach of these Terms.
Governing law, arbitration and fees
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms, the site or a product that cannot be resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in Erie County, Pennsylvania, or by videoconference. Either party may instead bring an individual claim in small-claims court. The Federal Arbitration Act governs this clause.
You and we each waive the right to a jury trial and to participate in a class or representative action. Claims may be brought only in an individual capacity.
If any party brings a claim that is dismissed, or loses in arbitration or court, that party will pay the other party's reasonable attorneys' fees, costs and expenses to the extent permitted by law. Any claim must be brought within one year after it arises or it is permanently barred.
Before starting arbitration, you agree to first email us at [email protected] with a description of the problem and give us 30 days to resolve it.
Changes and everything else
We may update these Terms by posting a new version with a new effective date; continued use of the site after that is acceptance. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, the Privacy Policy and the Shipping & Returns policy are the entire agreement between you and us about the site and our products. You may not assign your rights under these Terms; we may assign ours to a successor of the business.
